December 2012 – Bronx Grand Jury DISMISSES Robbery in Second Degree charges against client.

Client was arrested and charged along with three other individuals for the robbery and assault of a Chinese Food Delivery person. The defense put forth evidence that although the client was present in the area of the alleged robbery that he did not in any way participate in the commission of the crime.

Defense successfully put forth evidence before the Grand Jury that the client, who had just enrolled in college and had gainful employment, would not be so foolish as to risk his future to commit a violent felony offense.

The Grand Jury voted to dismiss all charges against the client. The Grand Jury did, however, indict the other 3 individuals that were arrested with Robbery in the 2nd Degree and other related charges.

Robbery in the Second Degree is a Class C Violent Felony Offense punishable by a mandatory minimum of 3 1/2 years in prison and a maximum of 15 years in prison.
